REIKI HEALING FOUNDATION and all its associate brands names under It (Healing Temple and Mind Magic India etc.) shall be referred to as “RHF” in the agreement.

Any user who shall be using the website for any purpose shall be referred as “USER” in the agreement.

www.reikihealingfoundation.net shall be referred as “Website” in the agreement.

Any payment made for online workshop, online services, appointments for services, treatments or donations shall be referred as “order?” in the agreement.

Any registration information or enquiry information shall be referred as “info” in the agreement.

 

GENERAL TERMS AND CONDITIONS

These TERMS AND CONDITIONS of use are a legal binding agreement between USER and RHF, a Delhi (INDIA) based Organization for the use of this website, including any order, donations or services made (if any). Access to and use of this website by any user is subject to these terms and conditions, including any modification or additions to these terms and conditions from time to time issued by RHF, and all applicable laws and regulations. by using this website, services through this website or placing an order through this website, user agrees to be bound by these terms and conditions in detail below:

BILLING AND PAYMENTS

  • USER shall pay all fees or charges to RHF’s account in accordance with the fees, charges, and billing terms in effect at the time a fee or charge is due and payable. If, in our judgment, USER purchase constitutes a high-risk transaction, RHF will require USER to provide RHF with a copy of USER’s valid government-issued photo identification, and possibly a copy of a recent bank statement for the credit or debit card used for the purchase.
  • RHF reserve the right to change products and product pricing at any time. RHF also reserve the right to refuse any ORDER USER place with RHF’s website. RHF may, in RHF’s sole discretion, limit or replace purchases per USER, per household or per ORDER. These restrictions may include orders placed by or under the same USER account, the same credit card, and/or orders that use the same billing and/or shipping address. In the event that RHF make a change to or replace an order, RHF may attempt to notify USER by contacting the e-mail and/or billing address/phone number provided at the time the ORDER was made.
  • RHF uses third-party payment system to assist in processing USER’s payment information securely. Such third-party processors’ use of USER’s personal information is governed by their respective privacy policies which may or may not contain privacy protections as protective as similar to RHF’s privacy policy. RHF suggests its USER to review the third-party’s respective privacy policies before making any transactions through RHF’s website.

CONTENT

  • You may not modify, print or copy any part of the Website. Inclusion of any part of this Website in another work, whether in printed or electronic or another form or inclusion of any part of the Website in another website by embedding, framing or otherwise without the express permission of RHF is prohibited.
  • Though RHF has full faith and confidence on its establishments and researches, yet, any information or content provided on RHF’s website is solely for the purpose of USER’s subject to study or learn about the information provided and not for any medical use or application or any other purpose to be fulfilled.

INTELLECTUAL PROPERTY RIGHTS

  • This Agreement does not transfer to you any intellectual property owned by RHF or third-parties, and all rights, titles, and interests in and to such property will remain (as between the parties) solely with RHF. All trademarks, service marks, graphics and logos used in connection with RHF’s Website or Services, are trademarks or registered trademarks of RHF or RHF’s licensors.
  • Other trademarks, service marks, graphics and logos used in connection with RHF’s Website or Services may be the trademarks of other third-parties. USER’s use of RHF’s Website and Services grants USER no right or license to reproduce or otherwise use any RHF’s or third-party trademarks.
  • Any unauthorized use of RHF’s intellectual property rights, content or material posted on RHF’s website by any USER will be considered as an illegal activity both online and offline by the FEDERAL COURT LAW OF INDIA, which shall give RHF full and complete right to demand a compensation for the loss of public image (in any manner, as per RHF’s demand) and investigation over the matter as per LAW of INDIA from the USER in COURT OF DELHI, INDIA.

 

REFUND OR REPLACEMENT POLICY

RHE understands that USER may change their mind from time to time and RHF wants to provide 100% satisfaction to its USER and add optimum and best experiences to its USER. For which, RHF offers return or 2 | replacement policy, which is valid for a period of 7 calendar days from the date of the purchase.

USER has received an ORDER placed through. RHF’s website and is not satisfied for any reason USER turn the item/product for a refund/replacement, if below mentioned criteria are met completely at the can re time of return:

  • lf the period of 7 days has lapsed since the date of purchase, RHF can’t, unfortunately, offer USER
  • refund or replacement.
  • ORDER must be unopened.
  • ORDER must be in original packaging.
  • ORDER must be unused.
  • ORDER must not be damaged.
  • To complete the refund, RHF requires a receipt, purchase order or other proof of purchase. Please note that without the aforementioned proof of purchase, RHF will not issue a refund.
  • Only regular priced items may be returned, unfortunately sale or clearance items cannot be returned.
  • In order to return an order, USER must contact RHF first and obtain and include a Return Merchandise Authorization (RMA). Returns will not be accepted without a valid Return Merchandise Authorization.
  • As soon as RHF gets the RMA number, refund will be processed within 10 days from receipt of returns of the ORDER from USER to RHF’s warehouse. User’s return payment/refund reflection may depend upon USER’s bank cycle.
  • USER must take care to ensure that the ORDER are properly packaged so that they will not be damaged while in transit. If the product is found to RHF be used beyond what it takes for USER to reasonably inspect it or damaged, then RHF may reserve a right to reject a refund.
  • USER will be responsible for paying for the shipping costs with regard to the items that USER wishes to return. RHF will not refund the shipping costs.
  • USER agrees and understands that replacement of any ORDER will depend upon the availability of the requested item/product with RHF’s warehouse. In case, the replacement fails, USER will be suggested/requested, to contact RHF for optimum solution, though we’ll try our best to correct everything in a timely manner.

In order to ensure the above criteria has been met, all returns will be inspected. if the product does not meet the listed criteria, RHF reserves the right to not issue a refund and reject the refund request.

 

SHIPPING AND DELIVERY POLICY

RHF takes the best measures to ensure the USER’s experience is error free and best in terms of delivery speed. Yet, delays in shipping and delivery can be caused due to various reasons, such as “item being out-of-stock” or “natural calamities” are unexpected and they do at times cause delay in regular on-going activities. RHF requests its USER to go through all shipping and delivery policy points mentioned below for better understanding.

  • RHF is currently limited to ship within INDIA only. We do not ship internationally. In case an international shipment is required for an order in that case the shipping shall be charged as per actuals accordingly.
  • As per nature of items/products/goods, RHF has ties with some particular courier services, who may not ship on National Holidays, SUNDAYS or SATURDAYS. This may result in delays of expected time of delivery. Though RHF will try its best to inform its USER in advance about the shipping and delivery information of the ORDER placed by USER.
  • ORDER will be processed only when the transaction made against any ORDER placed online through RHF’s website is completed and RHF has received the payment in their official bank account. Until, any ORDER placed will be considered as “NIL” or “NOT PLACED”. Usually all ORDERS are processed within 24 to 48 hours, once the payment is confirmed. However, certain category of items requires special packaging or their availability. In such cases ORDER processing may take time and final delivery may be delayed. USER will be informed in advance for shipping and delivery estimated time.
  • Shipping and Delivery may vary from distance and time to travel USER’s location within INDIA. Considering this issue USER should expect the cost and time of shipping and delivery shall also vary from time to time as per changes in courier services and Government policies. In such cases, RHF is not liable for any delays in shipping and delivery of any ORDER placed through RHF’s website.
  • Any cost at the time of delivery, other than paid on this website for shipping and delivery shall be payable by USER and RHF will not be liable for any cost incurred during shipping and delivery of the ORDER to the location of the USER.

 

PRIVACY POLICY

This privacy policy describes how RHF (“we”, “us” or “our”) collects, protects and uses the INFO that USER may provide on this WEBSITE. It also describes the choices available to USER regarding our use of USER’s Personal Information and how USER can access and update this information. This Policy does not apply to the practices of companies that we do not own or control, or to employ or manage.

Collection of personal information: We receive and store any information USER knowingly provide to

RHF when USER make an ORDER , fill any online form on the Website and Services. USER can choose not to provide RHF with certain information, but then USER may not be able to take advantage of some of the Website’s features. Users who are uncertain about what information is mandatory are welcome to contact us. RHF may collect personal information from USER in a variety of ways, including, but not limited to, when USER visit our website, register through the website, places an ORDER or provides INFO through forms for newsletters and in connection with other activities, services, features or resources RHF make available on RHF’s website. USER may

be asked for, as appropriate, name, email address, mailing address, phone number, credit card information. USER may, however, visit our website anonymously. RHF will collect personal identification information from USER only if they voluntarily submit such information to RHF. USER can always refuse to supply personally identification information, except that it may prevent them from engaging in certain website related activities.

Use of collected information: Any of the information we collect from USER may be used to personalize USER’s experience, improve RHF Website, improve USER’s experience on RHF’S website for any Services or ORDER and respond to queries and emails of our USER, process transactions, send notification emails such as password reminders, updates, etc., run and operate RHF’s Website and Services. Non-Personal Information collected is used only to identify potential cases of abuse and establish statistical information regarding RHF’s Website and Services usage. This statistical information is not otherwise aggregated in such a way that would identify any

particular USER of the system.

Collection of non-personal information: When a USER visits RHF’s WEBSITE RHF’s servers automatically record information that USER’s browser sends. This data may include information such as USER’s device’s IP address, browser type and version, operating system type and version, language preferences or the webpage USER were visiting before USER came to RHF’s Website, pages of RHF’s Website that USER visit, the time spent on those pages, information USER search for on RHF’s Website, access times and dates, and other statistics.

Privacy of children: We do not knowingly collect any Personal Information from children under the age of 14. If USER is under the age of 14, please do not submit any Personal Information through our Website. We encourage parents and legal guardians to monitor their children’s Internet usage and to help enforce this Policy by instructing their children never to provide Personal Information through our Website without their permission. If USER have reason to believe that a child under the age of 14 has provided Personal Information to us through our Website, please contact us.

However, no data transmission over the Internet or wireless network can be guaranteed. Therefore, while we strive to protect USER’s Personal Information, USER acknowledge that:

Data breach: RHF hold highest regards for its website USERs and will take all the reasonable and appropriate measures to protect its INFO provided through on our website. In the event we become aware that the security of the Website has been compromised or USER’s Personal Information has been disclosed to unrelated third-parties as a result of external activity, including, but not limited to, security attacks or fraud, we reserve the right to take reasonably appropriate measures, including, but not limited to, investigation and reporting, as well as notification to and cooperation with law enforcement authorities. In the event of a data breach, we will make reasonable efforts to notify affected individuals if we believe that there is a reasonable risk of harm to the USER as a result of the breach or if notice is otherwise required by law. When we do we will communicate with USER with best possible way available at the earliest, may it be e-mail, call, mobile messages, letter, etc. In such unexpected situations, RHF does not guarantee and will not liable for loss of any personal data of USER, breached by any third party outside RHF’s be surveillance.

We process information about USER in accordance with our privacy statement. USER must read our privacy statement which contains important information about the use of USER’s personal data and other information regarding USER’s privacy and our security processes and policies, and which forms part of these Terms. By using the Website, USER’s consent to such processing and USER warrant that all data provided by USER is accurate.

We may co-operate with any law enforcement authorities, or court order requesting or directing us to disclose the identity of or locate anyone breaching or otherwise for the prevention or detection of crime or the apprehension or prosecution of offenders. There may be other circumstances in which we may be required by law to disclose information about USER or USER’s use of our website.

We may investigate any reported breach of these Terms or complaints and take any action that we deem appropriate (which may include, without limitation, removing any of USER’s information, issuing warnings, suspending, restricting or terminating USER’s access to and/or removing any Materials from the Website.   • We are not responsible for Content residing on the Website. In no event shall we be held liable for any loss of any Content. ‘It is USER’s sole responsibility to maintain appropriate backup of their data stored on their various types of computer hard disks. Notwithstanding the foregoing, on some occasions and in certain circumstances, with absolutely no obligation, we may be able to restore some or all of your data that has been deleted as of a certain date and time when we may have backed up data for our own purposes. We make no guarantee that the data USER requires will be available.

  • To the maximum extent permitted by applicable law, the aggregate liability of RHF and its affiliates, officers, employees, agents, suppliers and licensors, relating to the services and ORDER will be limited to an amount greater of one rupee or any amount actually paid in cash by USER to RHF less shipping and handling for the prior six-months period prior to the first event or occurrence giving rise to such liability. The limitations and exclusions also apply if this remedy does not fully compensate the USER for any losses or fails of its essential purpose.
  • RHF will not be liable for any liabilities resulting from: –
    • The use or the inability to use the website content or ORDER by USER.
    • The cost of procuring substitute products or content.
    • Any ORDER purchased or obtained or transactions entered by USER into through the RHF’s website.
    • Any lost profits USER alleges.
  • USER agrees that regardless of any statute or law to the contrary, any claim or cause of action arising out of or related to use of the Website, Services or ORDER or this Agreement must be filed within six (6) months after such claim or cause of action arose or be forever barred.
  • Effect of Waiver: The failure of RHF to exercise or enforce any right or provision of this Agreement will not constitute a waiver of such right or provision. If any provision of this Agreement is found by court of competent jurisdiction to be invalid, the parties nevertheless agree that the court should endeavour to give effect to the parties’ intentions as reflected in the provision, and the other provisions of this Agreement remain in full force and effect.
  • RHF assure the USER that RHF use best resources to correct any errors or omissions as soon as practicable once they have been brought to our attention, but, RHF do not promise that the information on our website itself will be free from errors or omissions. RHF do not promise that our website will be available uninterrupted and in a fully operating condition and RHF cannot guarantee that any files that USER download are free from viruses, contamination or destructive features. Access to RHF’s website may be suspended and without notice in the case of system failure, maintenance or repair or for reasons reasonably beyond our control. All content on RHF’s website is provided on an ‘as is’ and ‘as available’ basis. TERMINATION PROVISIONS/DISPUTE RESOLUTION
  • The formation, interpretation, and performance of this Agreement and any disputes arising out of it shall be governed by the substantive and procedural laws of Delhi, India without regard to its rules on conflicts or choice of law and, to the extent applicable, THE LAWS OF INDIA. The exclusive jurisdiction and venue for actions related to the subject matter hereof shall be the state and federal courts located in Delhi, INDIA, and USER hereby submit to the personal jurisdiction of such courts. USER hereby waive any right to a jury trial in any proceeding arising out of or related to this agreement. The United Nations Convention on Contracts for the International Sale of Goods does not apply to this agreement.
  • USER will release, indemnify, defend and hold harmless to RHF, and any of its contractors, agents, employees, officers, directors, shareholders, affiliates and assigns from all liabilities, claims, damages, costs and expenses, including reasonable attorneys’ fees and expenses, of third-parties relating to or arising out of.
  • This Agreement or the breach of USER’s warranties, representations and obligations under this Agreement.
  • The Website content or USER’s use of the Website content.
  • The ORDER or USER’s use of the ORDER (including Trial ORDER).
  • Any intellectual property or other proprietary right of any person or entity.
  • USER’’s violation of any provision of this Agreement.
  • Any information or data USER supplied to RHF.
  • When RHF is threatened with suit or sued by a third party, RHF may seek written assurances from USER concerning USER’s promise to indemnify RHF. USER’s failure to provide such assurances may be considered by RHF to be a material breach of this Agreement. RHF will have the right to participate in any defence by USER of a third-party claim related to USER’s use of any of the RHF’s Website content or ORDER, with counsel of RHF choice at its expense. RHF will reasonably co-operate in any defence by USER of a third-party claim at USER’s request and expense. USER will have sole responsibility to defend RHF against any claim, but USER must receive RHF prior written consent regarding any related settlement. The terms of this provision will survive any termination or cancellation of this Agreement or USER’s use of the Website, Services or ORDER.
  • RHE reserves the right to terminate USER’s access to the Website if it reasonably believes, in its sole discretion, that USER have breached any of the terms and conditions of this Agreement. Following termination, USER will not be permitted to use the Website and RHF may, in its sole discretion and without advance notice to USER, cancel any outstanding ORDER. If USER’s access to the Website is terminated, RHF reserves the right to exercise whatever means it deems necessary to prevent unauthorized access of the Website. This Agreement will survive indefinitely unless and until RHF chooses, in its sole discretion and without advance to USER, to terminate it.

 

GENERAL TERMS (Continue)

  • USER Obligations: By using RHF’s website, USER commits.an agreement of not performing any illegal tasks/activities online that may interrupt, breach or break the code of law, which may result any security damage to the RHF’s website and hack RHF’s online data in any manner.
  • Changes and amendments: RHF reserves all the rights to modify this Agreement or any of its policies mentioned above relating to this Website or Services at any time, effective upon posting of an updated version of this Agreement on the Website. When RHF do, RHF will revise the updated date at the bottom of this page. Continued use of the Website after any such changes shall constitute USER’s consent to such changes.
  • Acceptance of these terms: USER acknowledge and signify that USER have read this Agreement and agree to all its terms and conditions and policies. By using the Website or its Services USER agree to be bound by this Agreement. If USER do not agree to abide by the terms and conditions of this Agreement, USER is not authorized to use or access the Website and its Services.

Note: RHF is an independent organization. All workshops, products, services, and treatments offered on this website are provided directly by RHF. No third-party merchants, organizations, or platforms are involved in the buying and selling process. Users agree to indemnify RHF against any damage or loss caused by third parties or organizations operating in a similar domain or offering similar services.
